IMPORTANT

If you have 2D barcodes (QR codes) printed on products, you should simply unsubscribe and ensure that each product is linking to a URL of your choice, this will keep the QR code functioning.

If you are an Amazon seller that ships product to France or Italy either FBA or FBM, you need to ensure your packaging carries the correct recycle logo otherwise you will be at risk of a fine upto €100k or worse up two years in prison according to French law. As far as warnings go, it is pretty severe.

It’s not just Amazon sellers, anyone that ships directly to consumer via their website (such as Shopify, WooCommerce) needs to have the correct logo. This is also true if you sell in any shop in Italy or France today. The laws have been in place since 2022 and all stock must carry these logos now.

It may sound simple. It’s far far more complex than that.

Each and every part of your product packaging needs to be accounted for. For example, if you have a beauty product in a tube, and it is sold in a cardboard box with a leaflet inside, your French and Italian environmental labels need to show each element, in the native language, along with the specific bins each element goes in to.

How do you get these labels?

You can pay expensive consultants, you can download the Triman pdf and have a stab at it (get it wrong, you get the fines/prison option), or you can use Buyerdock’s automated EU recycle logo generator (the demo is on our homepage). We charge a small fee starting at just £360 per year for 100x SKUs, this annual licence covers you for France and Italy now and will incorporate Spain and the UK next year (both will be mandatory) followed by Netherlands, Portugal and Poland – and then another 40 odd European countries that have all committed to this. Each with their own language recycle logo.

Do they need printing on pack?

In Italy, no, they can go behind a QR code, but if you have QR codes, you need to change them for 2D barcodes as per the global requirement from GS1 which is to move from linear barcodes to 2D barcodes in the next few years (we can help you with 2D barcodes too). In France, it depends on the size of your packaging, under our recycle tool in your Buyerdock account, if you know your packaging size, we’ll let you know whether you need to print on pack or display behind 2D barcode. tl;dr – almost all products currently need the French triman logo printed on pack.

When a country updates or adds new recycle logo regulation changes, Buyerdock will automatically update and we'll inform you if there are any further questions required to keep your products compliant.

Also, if a country launches new recycle logos, the account will automatically be updated for you, your annual licence fee covers all additional new countries launched during the calendar year you are subscribed to. An example of this is Spain. Right now (Sept 2023) Buyerdock provides the logos for France and Italy, Spain just announced their new logos, as complicated as the French Triman, once we have the full data-sets, we'll update the system and you will not need to pay any update fees.

If you decide not to continue to pay the monthly 2D barcode fee, the QR code will point to any website or webpage of your choice, the only difference is that the app will no longer load.

This is important if you are using the app for recycle logos, the product becomes non-compliant.

Buyerdock provides the 2D barcode free of charge, no payment sign up required. We strongly recommend using the app as the benefits to you are your consumer far outweigh simply sending a consumer to a web page or social media page.

The analytics show the following, please note, you are not allowed to identify the person due to EU law. But when you understand what tiles are being clicked most, you can focus more on updating that content to make it work better.

 

Q: We sell direct to businesses, where the end product is used by consumers, but no packaging. Example - we supply wine glasses in a box to restaurants. Do we need recycle logos?

A: The current recycle logos that Buyerdock provide are for B2C only. It is relating to consumer packaging.

This may change when authorities understand the volume of B2B. By signing up to the recycle licence, you'll get updated as and when this changes (and when new countries publish their logos) - the licence covers you for any updates

This is a question we are asked daily. Short answer, no. Long answer, it will.

Packaging regulations required include elements like Nutrition, Ingredients, Allergens etc printed on pack. This is not changing anytime soon. The EU and UK Gov are looking at how to reduce requirements on pack, but no decisions yet.

We think all post-purchase information such as company name and address, how to use, keep out of eyes regulatory logos (kite marks etc + recycling logos) can and will soon all go behind 2D barcodes. The EU have opened an infringement procedure with France as the triman logo printed on pack creates friction at the border. So we are sure this will be resolved behind the 2D barcode.

But we don't see any change with on pack regulations that are a matter of life and death anytime soon. If for example you are celiac, knowing the ingredients is crucial, the 2D barcode will help consumers read the ingredients easier and you can of course update your ingredients story to say Celiac friendly, Vegan etc etc.

We have a vision for the back of pack in the future, the following could be it, but for now, the only regulations we deliver are the recycle logo's and the French circular economy article 13.

If you have a number of products that are in essence the same, such as a nail varnish with 50 colours, the quickest way to add the products and update the regulations, such as recycle logos is as follows (TL;DR - simply add one product and duplicate it):-

Step 1

Go to the product you have added in your product collection. Click on the three dots on the right of the product listing, you should see the following options. Click Duplicate

Step 2

You'll see a pop-up, click ok.

Step 3

You'll see a warning, this is normal, in order to save you from actually having multiple GTIN numbers that are the same, we add the word 'DUPLICATE' after GTIN number and (duplicate) after the SKU - and title of the product.

Step 4

Simply visit each product, edit the title, add the correct SKU, and replace the GTIN for the correct one. When you click save, the errors will disappear and the recycling logos will be attached to the new product.

The European Union reform of Common Agricultural Policy (“CAP”), published on 6 December 2021, will enter into force on 1 January 2023.

Specifically, wine labelling will be regulated by EU Regulation 2021/2117, which amended four EU regulations, namely Regulations (EU) No. 1308/2013, 1151/2012, 251/2014, and 228/2013.

What does this mean in simple terms?

Any bottle of wine sold in the EU needs to have a QR code on it detailing full ingredients, allergens and nutrition. This law is applicable for wine sold in retail, sold in restaurants and bars. Basically if the wine is present in the EU it must comply.

Buyerdock has the functionality to deliver this via 2D-QR code now.

From the 1st January 2023, all products sold in France need to comply with Article 13, a component of the French Circular Economy law. This hugely complex and confusing regulation can be delivered by 2D-QR code and Buyerdock can now automatically deliver the required French language text by answering an additional set of questions.

Article 13 defines a series of environmental characteristics which require disclosure, depending on the product type. Characteristics for disclosure include attributes such as presence and amount of recycled content, recyclability, presence of hazardous substances, and traceability (amongst many others).

Not providing this information may risk your product being dropped from retail in the French market, €15k fine per non-compliant SKU and/or a fine of 10% of global turnover

You can add as many brands under your company as you want by going to the brands page accessed from the left menu.

Please note, you need to select the associated brand and attach it to the product under the General information tab on Edit Product pages.

NB: The About us tile on the app always shows the overall company name and detail.

Bear this in mind if you are building products for multiple brands and companies, it is best practice to have the owner/director set up the company account and then add users to manage it for them.

This can be done easily by going to Manage users here

There are three options as below:-

Admin(s)
Can manage company details, brands and products. Admins do not have access to any billing details, but they do have permission to view other user details and add/remove members.

Manager(s)
Managers are invited by the Owner or an Admin. Managers cannot edit/view other users. They can manage products.

Member(s)
Member are invited by the Owner or an Admin. Members can only view products, brands and analytics.

 

This is quite simple. Go to your dashboard.

Scroll down the page, you'll see a mock up of an app. Click on any element to see where the info is driven from.

Article 17 of the AGEC Law states that all household products, must bear the Triman logo and sorting instructions for each packaging element. This is law in France from 9th October 2022.

Depending on the size of your product, you may just need a 2D-QR code or more elements to become legal with respect to the size and type of product.

Once you select your packaging shape and size, we display what you need to add to packaging. For example if just the below image shows, you just need a 2d-QR code with the complete recycling logo showing inside the app:-

If your package is a certain size and shape, we may show this, this means you need a 2D-QR code with the complete recycling logo showing inside the app, plus the Triman logo on your packaging:-

In some cases you may need to show it all. If you see the following, you need all three elements on your packaging (making sure the recycling elements are completed fully as it will future proof you for other country changes - and the Italian law which is now live):-

The legislative Decree No.116 of 3 September 2020 is a law that was passed in Italy in September 2020. The law includes several provisions that are intended to promote the transition to a circular economy in the country.

This is law on all products sold in Italy from 1st January 2023.

You can ensure your product meets Italian regulations by completing the questions on the recycling tab on the Edit product page.

Please note: Your products only meet regulations once the 2D-QR code is applied to product

In the case of incorrect or missing labelling, fines of €5,200 – €40,000 can be imposed.

Article 17 of the AGEC Law states that all household products, must bear the Triman logo and sorting instructions for each packaging element. This is law in France from 9th October 2022.

This move was part of a broader effort to increase recycling rates in the country and reduce the amount of waste that ends up in landfills.

The Decree No. 2014/1577 itself does not state any penalties for not using the Triman logo. However, according to the applicable environment law in France (Art. L171-8 & L173-1), a warning can be issued by the responsible authorities. Thereafter, continuous non-compliance can result in financial penalties of up to €100,000 or up to 2 years in prison.

Please note: Your products only meet regulations once the 2D-QR code is applied to product and if an associated logo is required, printed on the packaging too.
